1. LICENCED ARMS
Q. How does one procure a new Arms Licence ?
Ans. By submitting an application in Form “A” in the office of Commissioner of Police.
Q. How much time does it take to decide grant or otherwise of an arms licence.
Ans. Minimum two months.
Q. What is the procedure to procure a new Arms Licence ?
Ans.
The application form is sent to the office of the concerned DCP for verification of the character and antecedents of the applicant through local P.S and to furnish specific recommendation for consideration of grant of Arms licence. On receipt of report from the concerned DCP, Commissioner of Police may conduct further enquiry and verification at his level from different sources. A decision thereafter is taken regarding grant or otherwise of licence.
Q. What documents are required to be submitted for obtaining a new arms Licence ?
Ans.
i.
Age proof.
ii.
Copy of treasury challan as regards depositing requisite licence fee for the arms applied for in the licence.
iii. Residential Proof.
Q. How does one renew an arms licence ?
Ans. Apply in the prescribed form, enclosing Treasury Challan regarding depositing of renewal fees. A date is fixed for physical verification of Arms Licence. Thereafter, licence is renewed.
Q. What is the procedure of renewal if the licence has expired more than one month back.
Ans. The licencee has to apply to the Commissioner of Police, enclosing a Treasury challan receipt regarding depositing of renewal fee and late fee i.e. amount for initial grant of licence.
Q. What is the procedure of renewal if the licence has expired more than a year back?
Ans. The licencee has to apply to the Commissioner of Police, mentioning the specific cause for non-renewal of the licence and enclose a money deposit receipt in the shape of treasury challan (licence fee + late fee) for consideration of renewal of licence by Commissioner of Police.
Q. If the licence holder is unable to come for renewal, can his agent renew his licence on his behalf?
Ans. If the licence holder is in Odisha, his agent should have the weapon carrying authority signed by the license holder and counter signed by him. He should also produce the weapon for inspection and pay the requisite fees. The renewal form has to be signed by the licence holder.
Q. In case where renewal of Licence is late since the licence holder is out of Odisha, What can be done?
Ans.
i.
Deposit the weapon in the nearest Police Station.
ii.
Fill up the renewal form and leave the licence with licensing section.
iii.
When the licence holder returns, he can come to office to collect the renewed licence.
Q. How to obtain a T. J. P. (Temporary Journey Permit)?
Ans.
i.
Submit an application on a plain paper with INR 5/- Court fees Stamp.
ii.
Attach a copy of the licence.
iii.
Next day, pay a fee of INR 20 and you will get a TJP.
iv.
This is only valid for 30 days and is subject to local restrictions imposed by the local authority
Q. How do one get a licence for property protection.
Ans. Same procedure for obtaining a new licence.
Q. My father/ uncle/ husband/ relatives was a licence holder. He has expired. The licence is in my possession. What should I do ?
Ans. Produce the weapon in the nearest Police Station or with the licenced arms dealer. A safe custody receipt will be issued to you.
Q. A relative wishes to possess the weapon of the deceased person. What is the procedure ?
Ans. He has to apply to the Commissioner of Police in Form “A” for issue of a new licence in his favour along with an affidavit of legal heirs with N.O.C. in the applicants name. The other procedure remains same as for procuring a new licence.
Q. My father/relative is old. He wishes to give me his weapon. What shall I do?
Ans. Make an application for Arms licence in Form “A”. Attach a consent letter of the licence holder with an affidavit. Attach a N.O.C. from other legal heirs, if any, with affidavit. The procedure remains the same for procuring a new licence. Please remember, grant of licence depends upon your eligibility to hold it and not on the wish of the donor.
Q. My all India Arms licence was issued in another State. I want it to be renewed at this place.
Ans.
i.
Submit an applicant in the prescribed form for re-registration.
ii.
Attach a copy of the arms license.
iii.
Produce/attach proof of residence.
iv.
An NOC from the original licensing authority is required.
v.
A police station report with remarks from the Zonal ACP is also required. On receiving the NOC and remarks from the DCP, a decision shall be taken by the licencing authority.
Q. My licence was issued in one place and I want to register it at another place. What is the procedure?
Ans.
procedure as outlined above for renewal of Arms Licence in another State.
Q. I want to make my licence valid in the whole of Odisha.
Ans. Make an application on a plain paper to the Commissioner of Police, requesting area of operation for all Odisha. Attach a copy of your licence for consideration. If the licencing authority i.e. Commissioner of Police permits you, then your licence will be changed accordingly.
Q. I want to make my licence valid in the whole of India. What should I do ?
Ans. Apply to the Commissioner of Police for the same. On receipt of your application, verification will be done by concerned DCP. If the Commissioner of Police finds the request justified proper genuine, he will send the arms licence and documents with his recommendation to Home Department (Govt. of Odisha) for extending the jurisdiction to all India. Home Department will take appropriate decision.
2.  FIRE CRACKER/EXPLOSIVES
Q. How can one obtain a licence to sell fire cracker?
  Apply to the licensing authority i.e. Commissioner of Police in Form No.4 of Explosive Rules by depositing INR 150/- licence fee under head 0070-Administrative Services receipts under Explosives Act.

NOC shall be called for from local police, Fire Officer, Asst.Electrical Inspector and Municipal Authority etc. After receipt, Commissioner of Police shall consider issuing licence in Form 24 of Explosive Rules.
Q. How can I obtain a Licence to store Explosive ?
Ans. Apply in form No.5 of Explosive Rules, 1962. The following documents are required:-
 
1.
Landlord’s NOC for the purpose of blasting.
i.
Fire Officers NOC/Electrical Inspection’s N.O.C.
ii.
Report from the concerned Police station through DCP.
3.  LICENCE FOR PROCESSIONS
Q. Who is authorized to grant of licenses for processions?
Ans. DCP, Cuttack and DCP, Bhubaneswar are authorized to grant licences for processions in their respective jurisdictions.
Q. Is there any prescribed format for applying for a licence procession ?
Ans. There is no prescribed format. An applicant can either submit a plain paper application or an application written on the letter head of his/her organization.
Q. What are the required documents/information which have to be submitted when applying for such a license ?
Ans. The following information has to be submitted:-
i.
Full name and address, contact no ( telephone and cell phone) of the individual applying for the licence.
ii.
Date and time of the proposed procession.
iii.
The route which the procession proposes to take.
iv.
Approximate number of persons expected to take part in the said procession.
v. Approximate duration of the proposed procession.
vi. Accompaniments like loudspeaker, music, band, dance troops, traditional equipment, religions symbols etc.
Q. What are the conditions generally prescribed while granting licence for procession?
Ans.
The following general conditions are prescribed:-
i.
The licence and the licensee shall remain with the procession throughout and the licence shall be produced on demand by a Police Officer of or above the rank of Havildar.
ii.
The date, time and route stated in the licence shall be strictly adhered to.
iii.
This licence does not permit playing of music or the performance of any act in such a manner as to amount to a public nuisance.
iv.
The procession shall proceed continuously at a reasonable pace from its starting point to its destination without stopping at place other than specified.
v.
The procession will move in such a manner as not to interfere with the ordinary use of the street or highway by the public. It will keep to the left hand side of the road and cease playing music and making other loud noise when passing a hospital/school and when meeting or passing a restive animal either ridden or driven and on passing private house when it has been made know to the licensee that there is any person dangerously ill therein.
vi. No fireworks (except mahatabs) shall be discharged on any public road, without proper license .
vii. No ‘lathis’ or other dangerous weapons may be carried by any one in the procession without obtaining special permission for the same thereof.
viii. Restrictions on use of loudspeaker, music, dance troops, band traditional equipments etc, if imposed shall be followed.
ix. Order of the Hon’ble High Court and the licencing authority specifically regarding decibel level of loudspeakers and use of firecrackers etc. shall be strictly complied.
Q. What is the penalty for violation of the aforementioned terms and conditions ?
Ans. Whoever disobeys, opposes or fails to conform to the conditions of the license can be penalized with a fine which may extend to INR 500/- U/s 99 of OUP Act-2003, besides stoppage of the procession and other legal action.
Q. What is the procedure for grant of such licence ?
Ans. The applicant has to apply to the office of the concerned DCP. The application is sent to the concerned P.Ss for verification. On receipt of verification report both from the IIC of the concerned P.S. and the zonal ACP, the same is further scrutinized in the Office of DCP before grant of license or otherwise.
4.  LICENCE FOR USE OF LOUD SPEAKERS
Q. Who is authorized to grant license for use of loud speakers ?
Ans.
DCP, Cuttack and DCP, Bhubaneswar are authorized to grant licences for use of loud speakers in their respective jurisdiction. Licence for use of loud speakers is granted U/s 4 of Odisha Fire Works and Loud Speakers (Regulation) Act-1958
Q. Is there any prescribed format for procuring this license ?
Ans. There is no prescribed format.
Q. What are the required documents/information which have to be submitted when applying for such a licence ?
Ans.
The applicant should submit the following information:-
i.
Full name and address, contact no( telephone and cell number) of the individual applying for license.
ii.
Date and time/duration/venue, when the loudspeaker is proposed to be used.
Q. What are the conditions generally prescribed while granting this licence?
Ans.
The following general conditions are prescribed:-
i.
That the public tranquility shall not be disturbed by any means. If public tranquility is disturbed, permission is liable to be cancelled.
ii.
Loudspeakers can not be used within a radius of 400 meters of any Hospital, court house, public offices, educational institutions etc.
iii.
That the permit should be returned to the issuing authority within a week after the date of expiry.
iv.
That the permit shall be produced for inspection as demanded by any police officers not the below rank of S.I. of Police.
v. That the applicant shall avoid using echo sound system and shall not cause annoyance to people specially Sr.Citizens, ailing persons and students.
vi. The Hon’ble High Court vide their order No.270 dtd.27.03.2008 in OJC No. 6721 of 1999 has passed an order pertaining to use of loudspeaker which inter-alia include the following:

All band parties using amplifiers along with some boxes and various musical instruments as well as DJs shall install SOUND LIMITERS connected to the amplifiers so that the decibels of sound produced by such amplifiers will not exceed 65 dB.
Q. What is the procedure for grant of such licence?
Ans. The applicant has to apply to the office of the concerned DCP. The application shall be dispatched to the concerned P.Ss for verification. On receipt of verification report from the IIC of the concerned P.S. and the zonal ACP, the same is further scrutinized in the Office of DCP before grant of licence or otherwise.
